I am the Moderator for the Non-LEO forums.  I am mainly responsible for the Non-Sworn Personnel, Communications Center and Security Personnel on this site. If you are new to the site I suggest that you read the Terms of Use (http://www.policelink.com/terms) and other valuable information on this site.

 

Please search the threads before posting a new one. Some of the questions that you might need to ask has already been asked, so please take the time to research your topic by using the search link. If you do not see it then post a new one.

 

Also remember that this site is for LEO’s, supporters, non-LEO’s and others that have an interest in Law Enforcement. We are all guests on here.



A little about me, I have been in the Security Field for 12 years, a Corrections Officer for 2 years. I also served as a Volunteer Fire Fighter for approximately 22 to 23 years.



I volunteered to be a Moderator on this site to help keep in run smooth. One of my job’s as a Moderator is to build a bridge between LEO's and non-LEO's alike (especially the Security People)

 

F.Y.I. to those that are in Security please be advised that Security Personnel and LEO’s ARE NOT the same. Security Personnel CAN NOT arrest people. This has been brought up a lot lately and please don’t bring it up in a topic.

First and foremost Welcome and bust of luck as a moderator! 


I would like to say that the statement security personnel can not make arrests is not totally true! A security officer is a private citizen that enforces the customer/clients rules and regulations while on duty while on the property of the site they are assigned. Furthermore the constitution of the United States has a provision that our fore fathers felt were needed and is still on the books in every state in the union call "Citizens Arrest". The requirements to make a citizens arrest are the following: 1) A person must witness a felony being committed in their presence, 2) you must have a reasonable belief that the person you witnessed committing this felony will escape or the person may commit another felony before the police can arrive. Security Personnel have a third requirement and that is: the Security personnel must have the permission of the client/customer to affect a citizen’s arrest (normally this is in writing in SOP’s or Operational Procedure Manuals).


 


In addition if one is familiar with the funnel effect they would understand that some states actually allow a citizen arrest for certain misdemeanor offences as well.


 


Trust you me if a person is trespassing on a government facility (nuclear plant, DOD property) the security personnel will detain that person for the police and we all know when you detain a person limiting the right to leave it is considered an arrest. Before anyone even says it yes there are more DOD, Nuclear, and Governmental facilities that use private contract security   personnel.


 


I am not trying to start things here I just think everyone should be aware of the laws that govern our great country. I think it is a shame that there are L.E. officers that feel a right granted by the Constitution of the United States is something to be taken lightly or to be laughed just because a Guard is involved.


 


This is just my opinion and this post was not made to offend or attach anyone!

BCSD4558, you have obviously educated yourself well. In the interest of your freedom, however, I would like to point out than an 'arrest' is made the moment you deprive a person of their freedom to leave. This can occur without touching the person. It is not defined by 'when you slap the cuffs on' as many people would believe. This means that you are subject to abuse of authority if you use your uniform and demeanor to intimidate someone to remain 'in your custody'.

I will not beat a dead horse, I think everyone here knows my sentiments. I just wanted to say that you are 100% correct Freezerburn, Not many people realize the factors of a non-custodial arrest. If you deprive anyone of their freedom of movement by ANY means be it verbally, with restraints or mearly by your presense and demeanor you are affecting an "arrest" so be very careful.

You’re both right, however as we all know the length of time one detains a person (verbally or physically) is dictated on the circumstances for the detention. It would not be unreasonable to detain someone 10 minutes to verify their id in cases of being in an unauthorized area or trespassing and yet if all checks out we let them go. We all know that when a cop writes a MV ticket in most states  citations are issued in lieu of arrest ( great tool when you have a real jerk off) yet the officer has to be able to articulate and justify why the process may have taken 20 minutes.


I agree with both of you that Security Personnel better be well trained and versed in these situations if they intend to do anything involving detaining or interviewing anyone.
