One of my secured site this question popped up, can anyone give them a fairly accurate answer.............


 


The LA Sheriff's Dept. has asked me to help them compile a listing of states where ownership of the .50 cal BMG (Browning Machine Gun) round is legal. I would appreciate any information or leads for compiling such a list that would include:



       1. States where private ownership is legal

       2. Relevant Code section

       3. Qualifications/conditions Summary



Anything you can send me by COB July 3 would be appreciated.

 Your post will probably go unanswered since the 50 BMG is legal in every state EXCEPT California. No other states limit the callibers of their weapons except CA (NJ is looking to be the second though, but that is still in the works). There is, however, a fedeal regulation on the size of callibers for weapons that all states recoignize.


The federal law states that a firearm is declared a DD (destructive device) if it is "any weapon of a caliber greater than 0.60 caliber which fires fixed ammunition." As long as the owner/dealer has a Class III firearms license and the weapon is registered as a DD, it is perfectly legal.

Riot is correct.  Our departments Chief has taken the stance for a .50BMG ban here.  Ironically we employ 5 Barrett's.  Ronnie has sent our Chief a nasty letter and even though they are still legal here, Barrett now refuses to service our PD.
